Aviation operators have limited time left to prepare their Safety Management System, Human Factors and Non-Technical Skills procedures and, where applicable, Flight Data Analysis Program documentation for CASA's 1 September 2026 transition deadline.
The deadline is more than an administrative milestone. CASA expects operators to submit procedures that are complete, accurate, integrated into the exposition and capable of being implemented in day-to-day operations. Late or incomplete submissions may expose operators to review fees, processing delays and practical risk as the final implementation date approaches.
This is the point in the transition where many operators find gaps between existing manuals, generic templates and the way the business actually operates. Those gaps should be identified and resolved before the submission window closes.
What must be submitted by 1 September 2026
Affected operators should be ready to provide CASA with regulator-ready procedures and supporting nominations.
SMS procedures
Safety Management System procedures must be documented, integrated into the exposition and aligned with the operator's actual risk controls, reporting pathways and assurance processes.
HFNTS procedures
Air transport operators must have Human Factors and Non-Technical Skills procedures ready for submission and implementation, including training and governance arrangements.
FDAP procedures
Flight Data Analysis Program procedures are required for applicable larger aeroplane and rotorcraft operations, including certain rotorcraft operations required to carry a flight data recorder.
Safety Manager nomination
Operators must nominate a Safety Manager and have the role, responsibilities and governance arrangements ready for CASA assessment and formal acceptance.
Submitting by the deadline allows CASA to update its records without additional fees. Late submissions are expected to attract CASA review charges.
Final implementation deadline - 1 December 2026
Submission is only the first step. Operators must also be ready to operate under the updated systems.
By 1 December 2026, affected operators must have fully implemented their SMS, rolled out HFNTS training where required, implemented FDAP where applicable and had their Safety Manager formally accepted by CASA.
From 2 December 2026, operators that have not met the requirements may be unable to continue operating unless they have secured an extension. That risk makes the September submission deadline strategically important: it leaves time to address CASA feedback before the final implementation date.
Operators should not treat the process as a document upload exercise. CASA will expect systems that are workable, defensible and embedded in routine operational practice. Procedures should be clear enough for staff to follow and robust enough to withstand audit, incident review or investigation.
Where procedures have been adapted from templates or older manuals, operators should check whether they still reflect current aircraft, personnel, management structures, reporting lines and operational risk controls.
How Brindabella Legal can help
Practical aviation safety support for CASA-regulated operators.
Gap analysis
Reviewing existing procedures against Part 119, Part 138 and CASA transition expectations so operators can identify and close compliance gaps before submission.
Procedure development
Preparing SMS, HFNTS and FDAP procedures that integrate cleanly with the exposition and reflect the operator's actual systems, personnel and risk controls.
Governance support
Documenting the Safety Manager role, responsibilities, reporting pathways and implementation structures needed for acceptance and ongoing compliance.
If you are not ready, now is the time to act
Operators that start now still have time to prepare high-quality procedures, resolve internal inconsistencies and submit documentation before the 1 September 2026 deadline. The available window is narrowing, particularly for operators that need to align several manuals, train staff and settle governance arrangements.
Brindabella Legal can assist with preparing, reviewing and implementing SMS, HFNTS and FDAP procedures from start to finish.
